(i) Objects
An Act to provide for setting out the practical regime of Right to Information
for citizens to secure access of information under the control of public authorities. In order to promote transparency and accountability in the working of every public authority, the Right to Information Act, 2005 (Act no.22 of 2005) was enacted by Government of India.
(ii) Features
- All Citizens possess the right to information
- Information includes any mode of information in any form of record, documents, E-mail, circular, press releases, contracts and samples of electronic media.
- Application in writing on plain paper and can also given by electronic means
- No reasons for obtaining information/record to be given
- Information to be supplied within 30 days. If information is a matter of life or liberty of a person, it can be had within 48 hours from the time of request.
- Every Authority under obligation to provide information
- Information affecting sovereignty of India, Security etc. and relating to third party is exempted
- The appeal can be made if information is not supplied or part supplied or denied within prescribed period of 30 days, to Appellate Authority within the institution. Appeal against the decision of the Appellate Authority can be made before State Information Commission.
- Penalty of Rs 250/- per day of default subject to maximum of Rs 25,000/- can be levied for failure to supply the information within the prescribed period.Disciplinary action can also be ordered
- Court has no jurisdiction to entertain or deal with Complaints/appeals arising out of the Act.
- Nominal fee of Rs 2/- per page is chargeable for supply of documents.
Implementations of RTI Act, 2005.
Measures taken:
Constitution of RTI wing
In each of Four Zonal Offices of Municipal Corporation, RTI wing has been set up, which is headed by a Superintendent level officer.
In the Head Office of Municipal Corporation, a RTI wing has been set up, which function as Nodal office for all RTI Act related matters.
Appointments
- First Appellate Authority:-
Commissioner, Municipal Corporation, Ludhiana has been declared as 1st Appellate Authority under the Act.
- Public Information Officer:-
Sh. K.S. Kahlon, Law Officer, has been appointed as Pubic Information officer.
- Assistant Public Information Officer:-
Superintendent (House Tax) of each the four zones has been appointed as Assistant Public Information officer of the concerned Zone. Since in Zone “A” and “D”, two Superintendents (Tax) are in position, therefore, for public Convenience both the Superintendents have been appointed as Assistant Public Information Officer
Receipt of applications & acceptance of application fee
The applications under the Act are received at all the four zonal offices of the Municipal Corporation.
Application fee prescribed under the Act, which is presently Rs 10/- only, is received by way of Demand Draft/ Bankers Cheque/ Postal Order and in cash also.
Special counter for acceptance of application fee:-
In the Head Office, Which is situated at Mata Rani Chowk, Near Clock Tower, for acceptance of fee in cash, special counter has been set up in Room No.35, Ground Floor.
Public Information
For public convenience, the room numbers of Public Information Officer, Assistant Public Information Officers, appointed under the RTI Act, 2005 have been displayed at the Notice Board, which has been affixed at the entry point of the Main Building of Corporation office.
Monitoring of applications
Regular monitoring of applications received under the RTI Act, 2005, is made at the level of Commissioner and Zonal Commissioners on weekly basis.
